Intoxication is not Sexual Consent

WA is one of the only jurisdictions in Australia that does not acknowledge how intoxication affects the ability of a person to consent to sexual acts in its Criminal Code. I believe that all Western Australians should receive the same protections as the rest of Australia regarding their right to freely and voluntarily given consent.

The WA Law Reform Commission has completed a review in the current state of WA's sexual consent laws. In this report, they support the message of WA Consent in legislating the fact that intoxication (by alcohol or other drugs) can affect a person's ability to consent to sexual acts. â€‹

Whilst this is a major step in the right direction, the WA Government has yet to officially comment on the review, and we are still waiting to see legislative change. WA Consent will continue to advocate for this change. Please sign the petition and spread awareness to this legislative gap!

Whilst WA Consent has completed what it can to reach its initial goal, WA Consent will continue to work behind-the-scenes with other organsiations to better the landscape for all victim-survivors of sexual assault.
